Is this legal in India?
Yes. Adultery is not a criminal offence in India. The Supreme Court struck down Section 497 of the Indian Penal Code in Joseph Shine v. Union of India (2018), holding that it treated a married woman as her husband’s property and violated Articles 14, 15 and 21 of the Constitution.
