Is this legal in India?
Yes. Adultery is not a criminal offence in India. The Supreme Court struck down Section 497 of the Indian Penal Code in Joseph Shine v. Union of India (2018), holding that it treated a married woman as her husband’s property and violated Articles 14, 15 and 21 of the Constitution. No adult can be prosecuted for an extramarital relationship.
Two things the judgment did not change. Adultery can still be pleaded as a ground for divorce and can be raised in proceedings about maintenance or custody under the relevant personal law. And it says nothing about the moral or personal consequences inside a marriage, which are real and are yours to weigh.
